Man Rear-Ended by Big Rig Given High 7-Figure Settlement

It was a few weeks into the Fall semester at Texas A&M University. Cars on a nearby highway were backed up a quarter mile in stop-and-go traffic. Closing in was the driver of a massive Freightliner, barreling towards the standstill at 67 miles per hour. Without slowing down, he rear-ended a university professor’s minivan with colossal force, throwing the car into the grassy median. The professor was rushed to a nearby hospital and diagnosed with a traumatic brain injury. At first glance, the man looked in good shape considering the crash’s brutality. Tragically, however, his TBI was life-changing. Jeff Paradowski of Paradowski Law used a crash reconstruction to connect the collision to his client’s damages, securing a high seven-figure settlement at mediation.

Jeff Paradowski met with the man and his wife at the hospital four days after the crash. After learning what happened, he began working up the case and filed his complaint against the driver and his employer. He uncovered the driver worked as an independent contractor for a national motor carrier. Consequently, the employer’s attorneys asserted they were not responsible for the driver’s negligence.

Jeff retained several experts to outline liability and highlight his client’s damages: an accident reconstructionist, a neuropsychologist, and a neuroradiologist. With the Defendant’s black box, the accident reconstructionist uncovered the driver braked only one second before impact. He said if someone had been in the back seat at the time of the crash, they would have been killed.

Next, Jeff prepared to secure the case’s entire value. He sought the best neurology experts in California and prepared his client to be evaluated. MRIs found signs of hemorrhaging throughout his brain three months after the incident. Then, to illustrate his evidence and expert testimony, he called on DK Global to create a trial-ready presentation if the case did not settle.

The crash reconstruction began with a side-view of the Plaintiff sitting in his minivan. Then, the Defendant’s 18-wheeler collided with the vehicle’s rear-end, sending it forward at a 45-degree angle. The driver’s seat collapsed from the immense force. Next, a top-down view illustrated the crash’s deadly dynamics. The Plaintiff’s brain was displayed, demonstrating the crash caused his coup-contrecoup injury. A molecular view of his brain showed how the collision's rotational forces sheared his axons, damaging the brain’s ability to transmit synapses and his overall cognition. Finally, the man’s medical imagery was colorized and laid over his 3D model to easily see his brain hemorrhaging.

Jeff reinforced his demand package with the animation and sent it to the opposing counsel. Both parties were unable to come to an agreement at the first mediation. After two more meetings and further discussions, Jeff obtained his client a high seven-figure settlement.
