8-Figure-Plus Confidential Settlement for Trucking Accident Victims
Derryberry Zips Wade, PLLC Utilizes Damages Animation Communicating Child's Injuries

The driver of an 18-wheeler sped through a Texas construction zone with his cruise control set, causing a catastrophic accident when he rear-ended a family vehicle with children as young as 2-years-old in the backseat. All of the occupants of the vehicle were injured due to the negligence of this truck driver, but 8-year-old Jane Doe’s injuries were the most substantial. Tragically, her life was changed in an instant, and she suffered from a traumatic brain injury, numerous skull fractures, femur fractures, and several internal injuries.

Derryberry Zips Wade, P.L.L.C. were hired to help Jane and her family after a tragic wreck with an 18-wheeler that left them with lifelong injuries and trauma. Knowing the value of visuals to help explain complicated medical procedures, Derryberry Zips Wade tasked the team at DK Global and their retained experts with creating an animation to accurately portray Jane’s traumatic brain injury, skull fractures, femur fractures, and internal injuries, as well as the invasiveness and difficulty of the procedures that Jane endured.

Medical Animation Depicts Severe Injuries and Rehabilitation

The presentation begins by showing Jane with an injury to her right eye. Jane’s skin then goes transparent to show the viewers what they otherwise wouldn’t be able to see: the large comminuted fracture across Jane’s skull and orbital socket, where the fracture to her orbit had caused swollen tissues to press onto the top of her eye, leading to discomfort and difficulty seeing. As the animation continues on to show the extent of her numerous skull fractures, the MRIs taken of Jane’s skull are placed side-by-side with the lifelike 3D model to help the viewers comprehend the imagery and location of each injury.

Next, large metal plates and screws come into the picture, and we see how they were fixated across Jane’s facial fractures – a key moment in which the viewer is able to perceive the painful rehabilitative measures that this child had to endure. Jane’s other injuries are also depicted, including lung contusions and a left femoral fracture which required large nails to correct its placement. The presentation concludes with enhanced imagery of Jane’s brain, notating the affected areas and their decreased functionality.

Derryberry Zips Wade relentlessly advocated for Jane and her family, successfully receiving an 8-figure-plus confidential settlement against the trucking company and its driver by utilizing an indisputable presentation.

"We wanted to give the jury a real-good picture of what all those injuries looked like. It really worked out well, it aided us. We used that as part of our damage demand that we made on the carrier, and it was also part of our mediation presentation - and so we thought it was a very valuable tool and resource."
