Man Brutally Attacked on Camera Receives Confidential Settlement

Under California law, business owners and their security guards have a responsibility to protect their patrons from dangerous third-party individuals. When one business owner failed to stop a man from attacking John after he accidentally dropped an item on the attacker’s car, John was beaten and forced to the ground, where the attacker repeatedly stomped on him.

The attacker, who was twice John’s size and weight, fractured John's skull in several places and caused a severe traumatic brain injury. Video surveillance taken of the incident revealed the apathetic security guards who watched as John was brutally assaulted. Tragically, they only stepped in when the attacker was finally finished.

Immediately after the attack, John began experiencing symptoms of a traumatic brain injury and was rushed to a nearby medical facility by his sister. While John was being examined by the doctors, his sister contacted Granth Crhoelman of California Injury, PLC who quickly met with John to offer help in seeking recovery.

To begin the process of obtaining justice for his client, Granth coordinated John’s transportation and medical appointments so that he could begin receiving medical examinations and treatment for his injuries. Granth filed a lawsuit against the owner of the complex for his guards’ idleness and failure to step in when they witnessed John being attacked. Soon after, Granth received a recording of the incident from a 3rd party witness. This recording turned out to be a key piece of evidence, which proved that the attack was an unreasonable reaction to a simple misunderstanding – and one that could have been easily prevented by the guards.

After gathering all the evidence and medical reports, Granth asked DK Global to enhance the surveillance footage and John’s imagery, in order to help show the incident and John’s lifelong injuries. From the footage, John was seen apologizing to the man when he is attacked and thrown to the floor. Then, with the help of Granth’s medical experts, the presentation took an inside look at John’s facial fractures and corresponding cognitive injuries, including PTSD, anxiety, and depression.

After several back-and-forth exchanges between the two parties, Granth went into mediation where he was able to attain a substantial, confidential settlement for John to aid him in his finances and future medical care.

Granth Crhoelman is the managing attorney at California Injury, PLC, a Southern California law firm specializing in personal injury cases, premises liability, and vehicle accidents.
