Visualizing Complex & Permanent Injuries from Workplace Fall

When a repairman carelessly left his toolbox in the middle of an entryway, the inevitable happened when an unsuspecting casino employee suffered multiple life-changing injuries.

Surveillance footage captured the repair vendor leaving the case behind and stepping outside shortly before the painful incident occurred. As she had done for years, the Plaintiff entered through the door and greeted a man nearby. Distracted and unaware of the toolbox, she caught her foot on the obstruction and fell, resulting in a fracture and dislocation of her elbow. Soon after her accident, she began experiencing abnormal and severe pain radiating from the location of her injuries. Her treating doctors later diagnosed her with complex regional pain syndrome (CRPS), an incurable condition dubbed “the suicide disease” that delivers extremely intense pain messages to the brain without stimuli. Along with her constant and irregular pain, she was also diagnosed with thoracic outlet syndrome (TOS), a condition that causes significant swelling and numbness.

These agonizing disorders completely disrupted the woman’s life. She needed to file for workers’ compensation to stay financially afloat through her slow recovery. The Plaintiff’s workers’ compensation attorney referred her to Michael Bigos of Berman & Simmons who agreed to help her hold the Defendant and his company accountable for their negligence. To demonstrate the Defendant’s liability, Michael obtained the surveillance footage from the casino and contacted DK Global to create an enhanced view of his client’s injuries.

The footage shows the woman writhing in pain on the floor before transitioning into a 3D model of her and her damages. The camera zooms in to her elbow and illustrates her fractures alongside the actual medical imagery from her hospital examination. Demonstrating the nuance and complexity of her injuries, the DK Global 3D animation then reveals how the trauma compressed her nerves, causing her to suffer from TOS. Michael’s client needed to undergo numerous corrective surgeries to relieve her pain. To this day, she endures the ongoing physical and mental trauma.

Michael Bigos handles complex personal injury cases. He is a Past President of the Maine Trial Lawyers Association and has served as a Governor of the American Association for Justice.
