MVA Survivors Attain $1.5 Million Settlement Using Medical Illustrations

According to the Insurance Institute for Highway Safety (IIHS), 143,000 people were injured in car accidents in 2019 where someone ran a red light. In Irvine, California, a driver carelessly entered an intersection on a red light, colliding with the Gomez family vehicle, and leaving them with lifelong injuries.

Oscar and Elena Gomez, married for over 40 years, were on their way to a doctor's appointment. Oscar had picked Elena up from work and was accompanying her. As the couple paused in an intersection to make a left turn, a negligent motorist T-boned their vehicle. Their truck rolled several times in a whirlwind of broken glass and debris, coming to rest upside down. Oscar and Elena hung inverted, suspended only by their seatbelts, their abdomens tightly constricted, until good Samaritans pulled them to safety.

Oscar and Elena were taken by ambulance to a local emergency room where doctors examined their injuries. CT scans revealed they both suffered abdominal bleeding and non-displaced fractures of their lumbar spine. However, Elena’s injuries were dire and required an exploratory laparotomy. Treating surgeons detected hemorrhaging in her mesentery, small intestine, and sigmoid colon. To repair these wounds, doctors ligated portions of her organs, removed the marred portions, and reconnected the healthy ends to each other.

As they both recovered, Oscar and Elena sought justice for their permanent, life-altering impairments. The Gomezes approached David Blain of the Law Offices of Ted B. Then, the resection of Elena’s intestines was portrayed, showing the numerous incisions and sutures needed to restore her gastrointestinal tract.

Once these visual demonstratives were presented during trial, the Defense realized it was smarter to resolve the case out of court. David secured a $1.5 Million settlement to aid Elena and Oscar in their future medical care and compensate them for the devastating disruption of their lives.
