Crash Reconstruction and Injury Presentation Assist in $10.2M Settlement

Speeding in his company’s Ford F150 at 70 miles per hour around 2:00 AM, an excessively drunk driver careened down a street in Cartersville, Georgia. He failed to slow down as he approached an intersection, ran a red light, and crashed into the driver’s side of Jane Doe’s SUV. Her vehicle was crushed, requiring first responders to use heavy machinery to cut through the wreckage and free her. Miraculously, Jane survived but was rendered comatose, suffering devastating head-to-toe injuries. With an abundance of proof showing the Defendant was fully liable, Jane’s attorney focused on communicating the collision’s severity and resulting damages.

Jane remained in the ICU for several weeks. Within a day of the incident, Jane’s family attorney, Darl Champion of The Champion Firm, P.C., arrived at the hospital and comforted her parents. Then, he immediately began organizing Jane’s claim.

Darl discovered the Defendant was grossly negligent after reviewing the police report and locating his employer. The report stated the man had a blood-alcohol level more than two times over the legal limit. Moreover, multiple eyewitnesses saw the Defendant driving erratically before he sped into the intersection. In fact, after obtaining the Defendant’s event data recorder, Darl learned the man was so impaired, he did not make any braking action before the crash. In addition, the Defendant was driving a company vehicle.

Once Darl found the man was covered by his company’s robust insurance policy, he looked to increase his case’s value with a reconstruction animation and damages presentation. Darl’s strategy was to give the carrier enough information to value Jane’s damages properly to make it easier to agree to the demand package. As his evidence amassed, he called on DK Global to recreate the incident and visualize Jane’s injuries. Darl intended to leverage the animation throughout the litigation process: he included it in his demand package, used it during depositions of experts, and was prepared to introduce it as a demonstrative exhibit at trial. If the opposition rejected his request to settle, Darl felt confident the animation recreating the Defendant’s dangerous intoxication and the brutality of the crash would compel a jury to award a verdict far larger than the policy limits.

DK Global animators reconstructed the collision using information from the event data recorder. Depicted was Jane Doe leaving a restaurant, waiting to turn left at an intersection. As she lawfully began her turn, the Defendant blindsided her. Next, the animation replayed using a camera angle directly behind and above the Defendant’s truck, demonstrating his reckless driving and failure to recognize the red lights ahead. After the crash, Jane was shown unconscious in her vehicle as it transitioned to a presentation of her injuries. The visual demonstrative displayed her degloved forehead, disc bulges, fractures, and more. Enhanced and colorized medical imagery revealed her skull fractures and intracranial hematoma, laid over a 3D model of her likeness. Finally, four illustrations summarizing Jane’s invasive surgical procedures were shown, including her left tibia fixation and her exploratory laparotomy.

With the DK Global visual exhibits, Darl was well-equipped to take the case to trial if needed. He included the animations in his demand package and sent it to the opposing counsel, attaining a $10.2 million settlement for Jane several weeks later.
