Construction Defect Animation Demonstrates Severe Water Intrusion

Moldy walls, rusted windowsills, and water seeping through the floor are not just a nuisance – if left untreated, these problems can affect a person’s overall health and quality of life.

When the owners of a downtown Hollywood condominium settled for poor craftsmanship when building their units, their decision to cut corners compromised many of their units’ structural integrity, making them uninhabitable and a major safety concern. Many of the tenants experienced water intrusion that caused moldy insulation, cracked drywall, and several other concerns due to water collecting in the planters that had no drainage.

The stagnant and pooling water was so severe, it caused noticeable damage to the garage walls two floors below. Daniel Rottinghaus and Howard Silldorf of Berding|Weil, LLP represented the tenants of the condominium against the owners, who failed to act quickly and make the necessary repairs that would ensure their high-end units were safe and structurally sound. To help create a comprehensive presentation that illustrated the building’s violations and defective workmanship, Daniel and Howard worked with DK Global to conduct an onsite inspection, and used the findings to create a 3D model of the building and its blueprint.

This Golden Advocate-winning presentation begins with a 3D view of the building, sprouting from the floorplans as the violations are highlighted. Footage from the onsite inspection is also used to show the unsightly and murky water that was ponding in the planters adjacent to the walls of the surrounding units. Then, the presentation demonstrates the water leaking under the windowsills and doorways, damaging the surroundings and creating a safety violation. Finally, to show just how severe and extensive the water damage was, photos of the garage’s walls and utility rooms are shown cracked and riddled with rust from the water dripping from two or three floors above.

With a clear and comprehensive presentation in hand, Daniel and Howard secured a confidential and favorable settlement for their clients and urged the owners to finally make the necessary repairs.
