Tragedy can strike when we least expect it, but it remains particularly prevalent when drivers commute with reckless abandon. In Los Angeles county, tragedy ensued when a driver lost control of his vehicle after hitting a bump in the road at an extremely high rate of speed, colliding with John, who was lawfully parked in his car on the side of the road. John was on his lunch break enjoying a quick meal before heading back to work, and in the blink of an eye, he was met with catastrophic and life-altering injuries due to the negligence of the other driver. Shortly after the accident, David M. Blain of The Law Offices of Ted B. John had a plethora of injuries blanketing his body as a result of the incident, including a parietal skull fracture, a scalp hematoma, fractures along his spine and ribs, a collapsed lung, a traumatic brain injury, and more. As many as 12 experts were retained by David, ranging from neuropsychologists to pulmonologists, to assess and quantify John’s damages. Miraculously, John made a speedy recovery and walked out of the hospital 2 weeks after the accident – but this didn’t mean that he would never again be plagued by the residual effects of his injuries. A photo of the incident showing John unconscious in his crumpled car moments after the crash began the presentation to show just how severe the impact was. A model of John was then brought into view while the camera panned head-to-toe to show John’s internal injuries. John’s emergency laminectomies were then depicted, showing the removal of parts of his vertebrae to allow for his spinal cord to swell without pressure. Finally, a 3D model of John’s brain was shown with its different regions highlighted to illustrate the traumatic brain injury and the associated physical and mental deficits.
After two days of presenting the visuals in mediation, David Blain was able to persuade the Defense to settle the case for $8 Million – only two days before trial.
