TBW Law Secures $1.45M for 17-Year-Old Girl Nearly Paralyzed From Fall

Summer camp: a nostalgic place for everyone to enjoy the outdoors and explore recreational activities like rock climbing. And that's exactly what the children at one church camp were doing, when a camp instructor delegated the important task of belaying the climbers - or holding the safety rope to help them down the wall - to four inexperienced, younger campers. Tragically, this irresponsible move on the instructor's part almost caused 17-year-old Jenny to become paralyzed; when she reached the top of the sixty-foot wall and let her belayers know that she was ready to come down, the safety rope slipped through the hands of the children and she plummeted to the ground.

Jenny was rushed to the hospital with several spinal fractures, but miraculously made a substantial recovery. The question still remained, however: why did the camp instructor and Jenny’s church allow inexperienced children to be given the enormous responsibility of ensuring Jenny’s safety?

Ted Wacker of the Law Offices of Ted B. Wacker was called to represent Jenny against the church for their inability to keep her safe during a time that was meant for joyful, memorable experiences. To help illustrate the incident, Ted Wacker worked with DK Global to create an animation that detailed exactly what happened, as well as Jenny’s resulting injuries.

The camp instructor responsible for the safety of the rock climbers was overseeing two different climbing walls at the time of the incident. The instructor made the inappropriate decision to assign four young campers to hold Jenny’s life in their hands - without any training, or even gloves. When Jenny was ready to descend from the wall, one of the belayers - who was unprepared and unfamiliar with the process - let go of the rope, causing it to slip and burn through the hands of the children behind him. This unfortunate series of events caused Jenny to fall sixty feet to the ground below.

After showing a reconstruction of the incident, the animation then zooms in to show an internal view of the complex fractures along Jenny's lumbar and thoracic spine, impinging her spinal cord.

With the help of this animation, Ted Wacker went into mediation and successfully attained a settlement of $1.45 Million to help with Jenny’s medical expenses and aid in her long road to recovery.
