Eight-Figure-Plus Settlement for Trucking Accident Victims Using Medical Animation

When the driver of an 18-wheeler sped through a Texas construction zone with his cruise control set, he rear-ended a family vehicle with children as young as two years old in the backseat. All of the occupants were injured, but eight-year-old Jane Doe’s injuries were the most severe. Her life changed instantly, suffering a traumatic brain injury, numerous skull fractures, femur fractures, and several internal injuries.

Jane was rushed to the nearest hospital where she required an overwhelming number of corrective procedures. Treating surgeons worked tirelessly to repair her injuries, securing large metal plates and screws to Jane’s skull, as well as a 27 mm rod into her femoral shaft. Ten days after the crash, the attorneys at Derryberry Zips Wade, PLLC were called to visit Jane while she and her family recovered. The trio agreed to represent them and seek justice after this tragedy left their whole family with permanent physical and mental traumas.

Even before filing a demand package, Daryl Derryberry, Craig Zips, and Guy Wade were determined to take this case to trial. However, between Jane’s myriad of injuries and the cascade of effects they would have for the rest of her life, there was a lot for jury members to wrap their heads around. To help build a cohesive argument, they brought DK Global onto their team of experts to help tell Jane’s story. DK Global worked with DZW’s retained health professionals, bringing Jane’s medical imagery into clear view as a 3D animation outlining her brutal injuries.

The presentation begins with the orbital fracture to Jane’s skull. Jane’s skin goes transparent to illustrate an anatomical view of how this fracture causes swollen tissues to press onto the top of her eye, leading to discomfort and difficulty seeing. Jane’s MRIs are then placed side-by-side with 3D animated injuries, giving the jury a clearer context of the extent and location of her damages. Next, large metal plates and screws come into the frame and are bolted across Jane’s fractures – a critical moment where viewers can perceive the painful rehabilitative measures that this child had to endure. Finally, Jane’s brain is recreated and highlighted, notating the damaged regions and their decreased functionality that will affect her for the remainder of her life.

Derryberry Zips Wade relentlessly advocated for Jane and her family, successfully receiving an eight-figure-plus confidential settlement against the trucking company and its driver using a medically accurate and captivating presentation.

"We wanted to give the jury a real good picture of what all those injuries looked like. It really worked out well; it aided us. We used that as part of our damage demand that we made on the carrier, and it was also part of our mediation presentation - and so we thought it was a very valuable tool and resource."
