Woman Struck in Crosswalk
Ankle Fractures & Knee Injury

While walking in a crosswalk, a 58 year-old woman was struck by a vehicle. She suffered a right ankle fracture, requiring fixation with metal plates and screws. The fracture caused chronic gait problems that resulted in a serious injury to her left knee. The plaintiff was represented by one of Berkeley, California’s leading personal injury lawyers, Attorney Susie Injijian. Ms. Injijian contacted Michael Caldwell for a consultation for a visual presentation that would help combat the controversial claim that the incident was not responsible for the left knee injury.

Michael developed a visual strategy to show the defense how strong the case would be if brought to trial. The project scope that he created included a customized character model of the woman that focused on the leg and ankle, and a colorized radiology study to identify internal fractures. Using medical imagery and reports from the treating physician, the presentation would also depict the woman’s subsequent mobility and stability issues.

The team at DK Global produced a 3D animated video that dynamically illustrates the severity of the woman’s injuries and required corrective procedure. Thereafter, the presentation displays how the fracture led to the chronic gait problems, which in turn, caused injury to her left knee. The animation successfully combated the defense’s argument. Despite the plaintiff's relatively modest medical expenses and absence of wage loss, attorney Injijian obtained a very favorable settlement in the amount of $400,000 for her client.

"The defense tried to deny that the collision caused the left knee injury, but they had a hard time doing so with the causal dynamic illustrated so vividly and convincingly by the animation. The animation was valuable in getting a top dollar settlement also because it showed we were ready to put on a compelling case at trial. Everyone at DK Global is great to work with. You worked with my budget and were responsive to my requests."

In this case, the cause of the left knee injury wasn’t obvious to the defense but the client knew it was a result of her ankle fracture, and the medical reports supported her claim. That’s why it’s so important to clearly demonstrate how injuries occurred when presenting your case. The visual presentations created by DK Global are vitally important for showing the progression of injuries.
